Scope

These General Terms and Conditions (GTC) apply to all deliveries from www.tea-herbs-spices.de (hereinafter Tea Herbs Spices) to consumers.

A consumer is any natural person who enters into a legal transaction for a purpose that is predominantly neither commercial nor self-employed.

 

Contractual partner

The purchase contract is concluded with ITPS GmbH, owner: Mr. Udo Schlott, Rollbarg 12, 25482 Appen, Commercial Register: Pinneberg Local Court, HRB 15440 PI.

 

Conclusion of contract

The presentation of the products in the online shop does not constitute a legally binding offer, but only an invitation to order.

By clicking the button [Buy/order with costs] you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation by e-mail immediately after receiving your order.

 

Right of withdrawal

If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.

If you, as a consumer, make use of your right of revocation in accordance with section 4.1, you must bear the regular costs of the return shipment.

Cancellation policy

You have the right to cancel this contract within fourteen days without giving any reason.

 

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the goods.

 

In order to exercise your right of withdrawal, you must inform us [ITPS GmbH, Rollbarg 12, 25482 Appen, e-mail: info@tea-herbs-spices.de] by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the enclosed model withdrawal form for this purpose, which is, however, not mandatory. You can also fill in and submit the model withdrawal form or another clear declaration electronically on our website (insert internet address). If you make use of this option, we will send you confirmation of receipt of such revocation without delay (e.g. by e-mail).

 

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the end of the cancellation period.

 

Consequences of revocation

 

If you withdraw from this contract, we must repay you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

 

You must return or hand over the goods to us or to (insert here the name and address of the person authorised by you to receive the goods, if applicable) without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

 

You shall bear the direct costs of returning the goods.

 

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the quality, characteristics and functioning of the goods.

Prices and shipping costs

The prices stated on the product pages include the statutory value added tax and other price components.

In addition to the stated prices, we charge a flat rate of 6.90 euros per order for delivery within Germany. The shipping costs will be clearly communicated to you again on the product pages, in the shopping basket system and on the order page.

If payment is made by cash on delivery, an additional fee of 2 euros will be due, which the deliverer will charge locally. Further taxes or costs do not apply.

 

Delivery

Delivery is only within Germany with DHL.

The delivery time is up to 3 days. We will indicate any deviating delivery times on the respective product page.

 

Payment

Payment can be made either by SEPA direct debit, cash on delivery or PayPal.

 

Retention of title

The goods remain our property until full payment has been made.

 

Dispute resolution

The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. More information is available at the following link: http://ec.europa.eu/consumers/odr. We are willing or obliged to participate in a dispute resolution procedure before a consumer arbitration board in order to resolve disputes with consumers in accordance with XXX (specify the legal norm or contractual agreement). The competent consumer arbitration board is: Universalschlichtungsstelle des Bundes Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. In order to settle the aforementioned disputes, we will participate in a dispute resolution procedure before this body.

Alternative Dispute Resolution pursuant to Art. 14 (1) ODR Regulation and § 36 VSBG:

The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr. We are willing to participate in an out-of-court dispute resolution procedure.
